Terms of Service
1. Who we are and what these Terms cover
Sugomi Apps, a sole trader operated by Mert Burak Dervişoğlu ("we", "us") publishes and operates the mobile game Idle Planet Defender (package com.idleplanetdefender.game, Android and iOS) and the player portal at idleplanetdefender.sugomiapps.com (together, the "Services"). These Terms are the agreement between you and us for your use of the Services. By installing, playing or signing in you accept them; if you do not accept them, please do not use the Services.
How we handle your data is explained separately in our Privacy Policy and Cookie Policy, which form part of these Terms.
2. Who may play
The Services are not intended for children under 13, or under the minimum age required in your country if it is higher. If you are a minor under the law of your country, you may only use the Services with the permission of a parent or guardian, who is responsible for your use of them and for any purchases you make.
3. Your account
You can play as a guest without creating an account — your progress is then attached to your device. You may optionally create an account with an email address and password, or sign in with Google. If you register with an email address, you must confirm the 6-digit code we send you before you can log in; unverified email accounts cannot sign in.
- One account per person. Do not create accounts to evade a ban or to gain an unfair advantage.
- Keep your password secret and do not share your account. You are responsible for everything that happens under your account.
- Tell us at [email protected] as soon as you think someone else has access to your account.
- Your account is personal to you. You may not sell, buy, rent, gift or transfer an account, and we do not recognize such transfers.
4. Licence to play
We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and play Idle Planet Defender for your own private, non-commercial entertainment. We and our licensors keep all rights in the game, including its code, art, audio, characters, names and design. Nothing in these Terms transfers ownership of anything to you.
5. Virtual items and in-game currencies
Coins, gems, scrap, ultimatter and in-game upgrades ("Virtual Items") are part of the game, not property. Your right to them is a limited, personal, non-transferable and revocable licence to use them inside Idle Planet Defender, granted for as long as we operate the game.
- Virtual Items are not real currency and have no real-world value.
- They may not be sold, traded, gifted or exchanged for money, goods or anything of value outside the game.
- Unused balances have no cash value, cannot be redeemed for money, and are forfeited if your account is closed or terminated for a breach of these Terms.
- We may add, change, rebalance, expire or remove Virtual Items and their in-game prices as part of normal live-game operation.
5.1 Randomized items ("loot")
Some features give a randomly selected reward: the Prize Wheel, arsenal part pulls and similar mechanics. Some of them can be started with Gems, which you may have bought with real money.
- The chance of each outcome is disclosed inside the game, on the "?" odds screen next to the feature, before you spend anything. Where an odds value can be improved by in-game progress, the screen shows your current, live chance.
- Each draw is independent unless the odds screen explicitly says otherwise. A run of bad luck does not entitle you to a specific outcome.
- Results are final. We do not exchange, re-roll or refund the outcome of a randomized draw, and Virtual Items spent on it are consumed even if you dislike the result.
- If we change the published odds, the change applies from the moment the game shows the new values.
5.2 Time-limited packs and entitlements
Some purchases are time-limited — for example a Command Pack, which runs for 30 days from purchase and includes an ad-free window for that period. Others are permanent for the life of your account, such as the Ad-Free purchase and tier Passes.
- Time-limited packs are not subscriptions and do not renew automatically. Nothing is charged again when the window ends; buying the same pack again while it is still running adds another full period to it.
- When a time-limited window ends, the benefits it granted (such as the coin multiplier or the ad-free window) simply stop. Items already delivered into your account stay with you. An expired window is not refundable.
- Permanent entitlements last for as long as we operate the game and your account exists; see section 10.
- Ad-Free means the game stops requiring you to watch a rewarded ad to receive the bonuses that would otherwise need one — those bonuses are granted directly. It is a convenience purchase; it does not change how advertising data would be handled if you did watch an ad, which is covered by our Privacy Policy.
6. Purchases and refunds
In-app purchases are sold and processed by Google Play or the Apple App Store, not by us. Your payment relationship for the transaction is with the store, and the store's terms apply alongside these Terms. We never receive your card details.
- Refunds follow the relevant store's policy. Please request refunds directly from Google Play or Apple. We can help with a delivery problem — for example a purchase that was charged but not credited — through the player portal.
- EU and UK withdrawal rights. We acknowledge your statutory right to withdraw from a purchase of digital content within 14 days. When you buy, you ask for immediate delivery of the content and acknowledge that you lose that withdrawal right once delivery begins.
- Apple App Store. On iOS, purchases are made from and refunded by Apple. Refund requests go through reportaproblem.apple.com. Purchases that can be owned only once (Ad-Free, Passes) can be brought back on a new device with Restore purchases in the shop; consumable items such as Gem packs are delivered once and cannot be restored, because they are already in your account.
- Google Play.On Android, purchases are made from and refunded by Google, under Google Play's refund policy. Non-consumable purchases are likewise restored from your Google account.
- Every purchase is verified with the store before it is credited. If a purchase is refunded, reversed or charged back, we may remove the items or entitlement it paid for.
- Prices, packs and offers may change, and availability, currency and price can differ by country and platform. The price shown by the store at the moment of purchase is the price that applies.
- Charged but not delivered? Open a ticket from the player portal with your store order number and we will fix the delivery.
7. Advertising
Idle Planet Defender is free to play, and rewarded advertising is part of the free game. The only ad format we use is the rewarded ad: you tap a button, watch a video, and receive an in-game reward. There are no banner ads and no full-screen ads you did not start yourself.
- Ads are supplied by Google AdMob. We do not control which specific advertisement is shown to you, and an ad appearing in the game is not an endorsement by us. Report an inappropriate ad to us and we will pass it on to the ad network.
- If an ad fails to load, is closed early, or the network reports no reward, the reward is not granted. This is not a failure of a purchase and is not compensated.
- Where the law requires it, we ask for your advertising choices before showing personalized ads, and you can change them at any time from Settings ▸ Advanced ▸ Ad Privacy. Declining keeps the game fully playable with non-personalized ads.
- You can remove the need to watch ads by buying Ad-Free or a Command Pack (section 5.2).
How advertising data is handled, and the choices you have, is described in our Privacy Policy.
8. Fair play — what you must not do
You agree not to:
- cheat, or use memory editors, speed hacks or any tool that alters game state;
- modify, decompile, reverse-engineer or create derivative versions of the game client;
- use bots, scripts, macros or any other automation to play for you;
- exploit a bug or error for advantage instead of reporting it to us;
- buy, sell, rent or otherwise trade accounts, progress or Virtual Items;
- abuse, harass or threaten other players or our support staff;
- attack, overload or attempt to gain unauthorized access to our servers or other players' accounts;
- circumvent a ban or any other enforcement action.
9. Enforcement, suspension and bans
If you breach these Terms we may warn you, reset part or all of your progress, remove Virtual Items obtained improperly, suspend your account temporarily, or ban it permanently. Our anti-cheat system may take some of these actions automatically when it detects manipulation. We aim to act proportionately to the seriousness and repetition of the breach.
You can always appeal. A banned player can still sign in to the player portal at idleplanetdefender.sugomiapps.com and open a support ticket — the ban only blocks the game itself. We will review your ticket and explain the outcome.
10. The game is a live service
Idle Planet Defender is an online, live service. We update it continuously and may add, change, balance, limit or remove features, events, content and Virtual Items, and we may suspend the Services for maintenance. We may also discontinue the game or any part of it. Where it is practical to do so, we will give reasonable advance notice of a discontinuation in the game, on the portal or by email.
11. Ending these Terms
You may stop using the Services at any time by uninstalling the game. You can also delete your account and its data from inside the game (Settings ▸ Advanced ▸ Your data ▸ Delete account) or from Settings on the portal; deletion has a 7-day grace period during which you can cancel it, and after that your data is permanently deleted or irreversibly anonymized. See Delete your account for details.
We may suspend or end your access if you seriously or repeatedly breach these Terms, or if we are required to do so by law. When an account ends, the licences in sections 4 and 5 end with it and any remaining Virtual Items are forfeited.
12. Disclaimers and liability
To the fullest extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, and we do not promise that the game will always be uninterrupted, error-free or free of loss of progress.
Limit on what we owe. To the fullest extent permitted by law, our total liability for all claims arising out of or relating to the Services is limited to what you spent on in-app purchases in Idle Planet Defender in the 6 months before the event that caused the claim — and to zero if you spent nothing in that period. We are not liable for indirect or consequential loss, lost profits, or for lost Virtual Items or progress caused by events outside our reasonable control.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or under your mandatory consumer rights. Your statutory consumer protection rights in your country of residence are not affected by these Terms — including the limit above, which never applies where the law says it cannot.
13. App store terms (Apple and Google)
You also have to keep the rules of the store you installed the game from. These Terms are between you and us only — not with Apple or Google.
- Apple and Google are not responsible for the game, for its content, or for providing maintenance or support for it; any support question goes to us at [email protected].
- If the iOS app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the app.
- Apple and Google are not responsible for addressing any claim you or a third party may have about the game, including product liability, a failure to conform to a legal requirement, or a claim under consumer protection or privacy law, nor for the investigation or defence of an intellectual property claim about the game.
- You confirm you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms for the iOS version of the game and may enforce them against you as a user of it.
- On iOS, Apple's standard Licensed Application End User Licence Agreement applies in addition to these Terms; where the two conflict on a matter Apple requires, Apple's minimum terms prevail.
14. If something goes wrong, talk to us first
Almost every problem — a purchase that did not arrive, a ban you believe is wrong, lost progress — is faster to fix through support than through anyone's legal system. Before starting formal proceedings, please open a ticket from the player portal or write to [email protected] and give us 30 days to put it right.
This is a request, not a waiver: it does not take away any right you have, does not stop the clock on any legal deadline, and does not prevent you from going to a court, a consumer authority or an alternative dispute resolution (ADR) body in your country at any time.
EU/EEA consumers. You can always contact the ADR body responsible for your country; your national consumer centre can tell you which one that is. We are not obliged to take part in ADR proceedings and, as a small independent publisher, we do not commit in advance to doing so — but we do commit to answering you directly, and we look at every ticket ourselves.
15. Governing law and where claims are heard
These Terms are governed by the laws of the Republic of Türkiye.
- If you are a consumer, that choice of law never takes away the protection of the mandatory rules of the country where you live. You may bring proceedings in the courts of your own country, and if we ever have a claim against you we will bring it there too — not in Türkiye.
- If you live in Türkiye, consumer complaints go to the consumer arbitration committee (tüketici hakem heyeti) or the consumer court where you live, under Law No. 6502.
- If you are not a consumer — for example you use the Services for a business — the courts and enforcement offices of Aydın, Türkiye have exclusive jurisdiction over any dispute with us.
- If you live in the United States, section 16 applies to you instead of this section.
16. United States: individual arbitration and class action waiver
This section applies only if you live in the United States. It does not apply to consumers in the EEA, the United Kingdom, Switzerland, Türkiye or anywhere else — their rights are set out in sections 14 and 15, and nothing here limits them.
- Talk to us first. Send a written notice describing the problem and what you want to [email protected] and give us 30 days to resolve it.
- Arbitration. If we cannot resolve it, you and we agree that any dispute will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court. The arbitration is conducted by a single arbitrator, in English, and may take place remotely or in the county where you live.
- Small claims stay in court. Either of us may bring an individual claim in a small claims court instead, and either of us may go to court to stop misuse of intellectual property.
- No class actions.Claims are brought only in an individual capacity, not as a plaintiff or member of a class, collective or representative action, and the arbitrator may not consolidate more than one person's claims.
- You can opt out. Email [email protected]with the subject "Arbitration opt-out" and your player handle within 30 days of first accepting these Terms. Opting out costs you nothing, changes nothing else in these Terms, and we will not treat you differently for it. If you opt out, disputes go to the state or federal courts located in Türkiye or your home state as permitted by law.
- If the class action waiver is found unenforceable for a claim, that claim is separated out and heard in court, while the rest stays in arbitration.
17. Changes to these Terms
We may update these Terms — for example when we add features or when the law changes. We will update the effective date at the top and, for significant changes, tell you in the game or by email before they take effect. If you continue to use the Services after an update, you accept the revised Terms; if you do not accept them, please stop using the Services and delete your account.
